Terms of Service

These Terms of Service (Terms) govern your access to and use of Zinq Mail’s enterprise email management platform, websites, applications, and related services (collectively, the Services). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who we are

2. Eligibility

You must be at least the age of majority in your jurisdiction and have the authority to bind your organization (if applicable) to use the Services. You represent that your registration information is accurate and kept up to date.

3. Accounts, security, and responsibility

  • You are responsible for safeguarding your credentials and the security of your devices.
  • You are responsible for configuring and maintaining valid IMAP/SMTP credentials for your mailbox provider.
  • You are responsible for all activities under your account and for complying with your organization’s and email provider’s policies.

4. Acceptable use

  • Do not use the Services to violate law, infringe rights, or send spam, malware, or unlawful content.
  • Do not reverse engineer, interfere with, overload, or disrupt the Services or related infrastructure.
  • Do not attempt to gain unauthorized access to accounts, systems, or data.
  • Comply with applicable email and anti-spam regulations (e.g., CAN-SPAM, GDPR, ePrivacy, local laws).

5. Email connectivity and data handling

  • The Services connect to your email provider via IMAP/SMTP to fetch, display, send, move, and update messages and folders.
  • Your IMAP/SMTP password is not stored in plaintext. An encrypted form may be held in an HTTP-only session token so the server can perform operations on your behalf.
  • Email content is processed on demand. Persistent storage primarily contains user settings and optional AI-derived metadata (e.g., summaries/categories/intent) you choose to enable.

6. AI features

  • AI features (summaries, categorization, intent detection) are optional and require configuration.
  • If you enable third-party AI providers (e.g., Anthropic Claude or Google Generative AI), relevant content may be sent to those providers subject to their terms and privacy policies.
  • If you use a self-hosted Zinq AI/OpenWebUI endpoint, you are responsible for its security and compliance.

7. Third-party services

The Services may rely on third-party providers (e.g., hosting, analytics, AI, email transport). Your use of such providers is subject to their terms. We are not responsible for third-party services we do not control.

8. Fees and payment

If applicable, pricing and billing terms are set out on the Pricing page or in your order form. You agree to pay all fees when due. Taxes, duties, or levies are your responsibility, unless stated otherwise.

9. Intellectual property

  • We and our licensors own the Services and associated intellectual property rights.
  • You retain all rights to your content and email data. You grant us a limited license to process your content solely to provide the Services.
  • Trademarks, logos, and brand features are used with permission and remain the property of their owners.

10. Confidentiality

We will not disclose your confidential information except as required to provide the Services, comply with law, or with your consent. See the Privacy Policy for more details.

11. Warranties and disclaimers

  • The Services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law.
  • We do not warrant that the Services will be uninterrupted, error-free, secure, or meet your requirements.
  • You are responsible for ensuring your use complies with applicable laws and policies.

12. Limitation of liability

To the maximum extent permitted by law, neither Zinq Mail nor its owners, affiliates, or suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, data, or goodwill, arising out of or related to your use of the Services. Our aggregate liability shall not exceed the greater of (a) the amounts paid by you to us for the Services in the 12 months preceding the claim, or (b) USD $100.

13. Indemnification

You agree to defend, indemnify, and hold harmless Zinq Mail and its owners, affiliates, and suppliers from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

14. Termination

We may suspend or terminate your access to the Services at any time for breach of these Terms, suspected misuse, legal compliance, or to address security risks. Upon termination, your right to use the Services ceases immediately. Sections intended to survive (e.g., IP, confidentiality, disclaimers, limitations, indemnity) shall survive.

15. Changes to the Services and Terms

We may modify or discontinue the Services or these Terms at any time. Material changes to Terms will be posted within the Services with an updated “Last updated” date. Your continued use constitutes acceptance of the updated Terms.

16. Governing law; venue

These Terms are governed by the laws of Germany, without regard to conflict of law principles. Exclusive venue for disputes shall be in the competent courts of Lower Saxony, Germany, unless mandatory law provides otherwise.
